Geographical indications are indications that identify a product as originating within the territory of a member state or a region or locality in that territory; where a given quality, reputation or other characteristic of the product is essentially attributable to its geographical origin. (Article 22 (1) of Agreement on Trade Related Aspects of Intellectual Property Rights).

Most commonly, a geographical indication includes the name of the place of origin of the products. For example, agricultural products typically have qualities that derive from their place of production and are influenced by specific local factors, such as climate and soil.

Namibia does not have a sui generis legal instrument for the protection of Geographical Indications. However, products can be protected by registering it as collective marks under the existing Industrial Property Act, 2012 (Act No 1 of 2012). Namibia is still exploring the best possible means to protect Geographical Indications, and is engaged in deliberations at both regional and global platforms.
