REQUEST FOR COMMENTS AND INPUTS ON THE DRAFT AMENDMENT TO THE

INDUSTRIAL PROPERTY REGULATIONS (REGULATIONS NO. 114 OF 2018)

The Business and Intellectual Property Authority (BIPA) is a Public Enterprise under the Ministry

of Industrialisation and Trade and is established in terms of section 3 of BIPA Act, 2016 (Act No.

8 of 2016), to register and protect business and intellectual property rights in Namibia.

Additionally, BIPA is obliged to review and facilitate the development of intellectual property

laws as well as provide customer-friendly and efficient delivery of Intellectual Property

registration services. In line with the above stated obligation, BIPA has formulated a draft

amendment to the schedule of fees under the Regulations of the Industrial Property Act, 2012.

The objectives of the Draft Amendment are to:

Consolidate basic IP fees (i.e., application, registration, publication and certificate fees) into a

single fee payable at application for registration of Intellectual Property Rights.

To improve efficiency in the registration process of the Intellectual Property Rights

To reduce turn around times for the registration of Intellectual Property Rights.

To ensure an inclusive and effective amendment process, BIPA will convene stakeholder

consultation workshops around the country to solicit comments and views concerning the

proposed draft amendments to the Industrial Property Regulation where stakeholders are invited

to provide inputs and comments on the draft amendment. The date, and venues will be

communicated in due course.
