FRAUD/SCAM ALERT

Dear BIPA Stakeholders,

The Business and Intellectual Property Authority ( was established in terms of section 3 of the BIPA Act, 2016

(Act No 8 of 2016 One of the functions of BIPA is to regulate and administer the registration of businesses and

industrial property under the applicable legislation, that being the Companies Act, 2004 (Act No 28 of 2004 and

the Close Corporations Act, 1988 (Act No 26 of 1988).

It has come to the attention of the Authority that there are individuals that have and continue to make themselves

guilty of fraudulent activities by scamming potential business owners and fraudulently registering businesses as if

they were approved and registered by BIPA, rendering these documents null and void.

It must be noted that in terms of section 6 2 of the Companies Act, 2004 the Registrar ( is the only authority that

holds the power to register businesses in Namibia.

Any person that makes themselves guilty of impersonating a BIPA official and producing false documents,

commits the crime of forgery and uttering This is a common law crime in terms of Schedule 1 of the Criminal

Procedure Act as amended, 2004 (Act No 25 of 2004 and is punishable by law.

BIPA hereby informs the public that we do not appoint third

party individuals as representatives to conduct any business

registration and intellectual property related activities on
