AMENDMENT TO REGULATIONS MADE IN TERMS OF THE INDUSTRIAL PROPERTY ACT

1 OF 2012.

Under Section 236 of the Industrial Property Act, 2012 (Act No.1 of 2012), I amend the regulations

set out in the Schedule.

SCHEDULE

Definitions:

1. In these regulations “the Regulations” means the Regulations made in terms of the Industrial Property

Act 1 of 2012 published under Government Notice 114 of 2018 .

AMENDEMENT OF ANNEXURE 1 OF THE REGULATIONS

Patents and Utility Models

2. Annexure 1 (B) of the Regulations is hereby amended by:

(a) The substitution of the Description “Application Fee” with “Basic Application Fee”:

“1. Basic Application fee N$”

(b) The consolidation of the Application, Registration and Publication fees for Patents into a once-off

fee deemed “Basic Application Fee”:

“Patent 1500”

Models into a once-off fee deemed “Basic Application Fee”:

“Utility Model 1200”

(d) The substitution of the “Registration and publication” and “Certificate of utility model” fees with

N$ 0.00:

“12. Registration and publication 0

30. Certificate of utility model 0”

Industrial Designs

3. Annexure 1 (C) 1 of the Regulations is hereby amended by:

(a) The consolidation of the Application, Registration and Publication fees for Industrial Design into

a once-off fee deemed “Basic Application Fee”:

“Fee for single design 450”

(b) The substitution of the “Registration fee”, “Publication fee” “Certificate of registration” fees with

N$ 0.00:

“7. Registration fee 0

8. Publication fee 0

9. Certificate of registration 0”

Trademarks, Certification and Collective Marks

4. Annexure 1(D) of the Regulations is hereby amended by:

(a) The consolidation of the Application, Registration, Publication, and Certificate fees into a once-

off fee deemed “Basic Application Fee”:

Fee for mark in one class 1200

(b) The substitution of the “Registration and Publication fee”, and “Certificate of registration” fees

with N$ 0.00:

“9. Registration and Publication 0

10. Certificate of registration 0”
